The dispute over the future of Carlos Tevez is scheduled for the High Court on 22 August - but West Ham are still hopeful of a settlement before then.
Hammers striker Tevez's representative Kia Joorabchian issued a writ to try to seal a £30m move to Manchester United.
The court date over economic rights was set at Tuesday's preliminary hearing.
It would mean the 23-year-old missing the first three games of the season but should ensure he can join United before the transfer window shuts on 31 August.
Tevez's switch to the Premier League champions has stalled over who will be paid the £30m transfer fee.
He is registered with West Ham but Joorabchian's companies MSI and Just Sports Inc claim they own the economic rights to the Argentine.
But there appears to be some light at the tunnel, with his future set to be decided before the end of August.
