Staring is not constituting to provoking a fight.
Exchange of heated statements also not.
Holding a seemingly weapon on the salesperson's hand can be defend by saying that he was using that at work.
Grabbing someone's hand and had a friend attacking the person, that constitute as starting a fight.
The salesman can sue you under civil proceedures if there was a police report.
