i am 20(21 this year) and recently was caught shoplifting at a mall. i honestly did not have any itention to steal. i dunno how i ended up walking out of the store with the item unpaid for. the item cost ~20 and i had ~80 with me. im from a pretty well to do family.
my record is really clean, no bad records in school, ns.
my IO says he is very very confident i will get a stern warning only.
however, i am still worried.
anybody has gone through anything similar before?

Well, unlucky. My guess is the shopkeeper, out of jealously for your life, chose not to exercise his discretion and allow you to pay for the item. Some people hate kids, others hate those who, gasp, attend a school or are well to do.

Don't provoke them into taking serious action.
Some people kena caught still want to act tough.
These will have to follow procedure. Charge, trial, sentence.

Only you know what truly happened, it's hard to second guess what's gonna happen without the full incident in detail.
For you to escape being charge or having something to mount a defense if charged, is how your reaction was inside the store? What was recorded by cameras and what did the Security Officer notice about you and your actions if any?
If you really just absent mindedly left, then you have a chance, but if you were looking left and right trying to avoid detection, or hid the item in a bag etc, then it wont look good.
Also against you, is your age, a teenager or school kid, would stand an excellent chance of warning.
But for you, is the amount of item and if the store doesn't want to pursue it, then you stand a chance.
It can go either way, depending on your actions that day and most crucially what statements you gave to the police. If you admitted to theft, then it might count against you. But if you maintained your story throughout and it can be corroborated by video and witness evidence, then you have a chance.
IOs can say a lot of things and he obviously has a say in the matter, but it's not up to him to make the decision, it's the AG's Chambers that decides. However I believe for neglible amounts (normally involving young offenders), the decision is sometimes left to the division concerned, and in these cases, the IO's boss - the Head Investigation (HI) can make the final decision. You stand a better chance with the HI, if the IO made a recommendation for warning, but again I must stress, it depends on your actions and statements.
Which division is the IO from?
Some cases they will drag for like 1 to 3 years before they close the case even if its simple cases like shoplifting..
What difference does it make what division the io is from? Also how long does the investigation take? Has yours been resolved yet?
