The law is not stupid, and is based on scenarios. You twist the story until like that, of course won't convict of murder. You want twist, i also can.
Shoplifter got caught, surrounded by people. They start beating him, breaking every bone in his body, using metal rods and fire extinguisher, and dies. Police come, they all get charged for murder. The people argue that they just want to hurt him a bit. The judge sees the thief's multilated body, and convict them all.

I think perhaps my view and skythewood's can be reconciled by pointing out the different factual matrix.( I did not realise he was going on the assumption that the shoplifter merely stealed.) If of cos the shoplifter did not resist, and yet he was killed in cold blood as what skythewood described, then the shopkeeper and the passer-bys will be guilty of murder. But if they merely gave him a few blows, it is unlikely that they will be charged as it is always a question of fact whether reasonable force was used to defend property.
