It's not so much the act mate, more the section actually. Anyway, that's why it's classified as a non-seizable offence. The victim will need to assist the Police by lodging a complaint with the magistrate, and then we will see what the magistrate has to say.
Either the file comes back to the Police to commence further investigation, or the Police initiate the investigation after reviewing the case on its own merits.
Each non-seizable case is treated on a case-by-case basis. Provided the offence disclosed is classified as a non-seizable offence, that is.
If not, then normal procedures will apply.
