Yes he goes to jail, but he still has to pay, even when he is IN JAIL!!! the judge may reduce the payment amount for the period he is in there, (case by case basis) but he still has to pay...all of what is owing.Originally posted by shinta:when u take him to the courts, the worse case scenario... he gets thrown into jail.. tats not that good if he has a job, but htats a good thing for my father cos he actually said he enjoyed his life inside there..![]()

nope.. that is not the only thing...his assets and property can and may be seized to sell off and pay his debts..the money earned will be used to pay for his outstanding payments...any balance left over will be held in trust and paid out on a monthly basis. My dads car and house was seized and sold in this manner for payment of his outstanding alimonys and held in trust for me and my brother, we mother received a monthly some for our maintenance until we turned 21.Originally posted by shinta:but if he delays n delays n delays... he just keep goin in to jail again n again n again....

can i sue my father for not paying shan yang fei for 13 years????
he's supposed to pay us $1000 a month. everytime my mother or i call him up to pay, he will give a lot of excuses like, "i still owe the bank $7000..." "i still owe ppl $xxxxx..." "i also no money."
CRAP.
he has another family. while we live in 3room flat, he and his family of one wife and one 5 year old daughter live in 5-room flat. he got new car, handphone... we have none of these. so how can he say he has no money? don't bluff lor. and he buy so many toys for his daughter. (sometimes when i ask him to drive me to places, i see so many toys in his van. or i go his office to photocopy things i also see so many toys lying on the floor. kaoz.)
so while he's living happily on the other side (actually i also dun care he happy or not. give us what you owe us ok!), my mother is struggling to take care of me and my brother with her pathetic pay of $900 a month!
soooo...can i sue him? and what would we get if he really has no money or not enough money to pay?
thanks.

my mother was hesitating to sue him because of the fees she has to pay to consult a lawyer...now then i know what the Legal Aid Bureau is for..thanks! ^^
